1. Introduction
Welcome to CalmBrookGarden ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at calmbrookgarden.sbs (the "Service") operated by CalmBrookGarden.
By securing a charter or utilizing our Service, you consent to these Terms. If you do not accept these terms, you are prohibited from using the Service.
2. Service Overview
CalmBrookGarden offers high-end yacht charter services that include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Availability of services is dependent on various factors and we retain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter reservation prerequisites include:
- A minimum age of 18
- Submission of truthful and complete details
- Advance payment of a stipulated deposit per your booking confirmation
- Adherence to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is contingent upon our acceptance of payment and issuance of written confirmation. Service denial remains at our full discretion.
3.3 Availability
We commit to reasonable efforts to cater to your preferred charter dates and times, subject to yacht availability and favorable weather conditions.
4. Payment Terms
4.1 Pricing
All charges are presented in € and are inclusive of taxes unless specified otherwise. Prices are subject to amendments without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the complete charter price due upon reservation
- Balance: Payable 48 hours before the charter’s commencement
- Extra fees (when applicable): Due after the charter's completion
4.3 Payment Methods
We accept major credit cards, bank transfers, and authorized cheques. All payments are processed through secure, encrypted gateways.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours notice before departure: Entire refund minus processing charges
- Notice between 24 to 72 hours before departure: Refund of 50% of the costs
- Fewer than 24 hours notice before departure: No refund
5.2 Weather Cancellations
Should our captain decide that weather conditions are unsafe, we will propose to:
- Reschedule your charter to another suitable date with no additional charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
In the case of mechanical issues with the assigned vessel, we will make efforts to provide a comparable replacement. If this is not practical, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Adhere to all instructions given by the crew
- Wear safety equipment when specified
- Inform of any health conditions that could impact their safety
- Stay within safe areas designated on the vessel
6.2 Prohibited Items
Items not permitted onboard include:
- Glassware
- Illegal substances
- Firearms or any form of weaponry
- Excess refreshments (beyond moderate consumption)
- Animals (exceptions made if previously authorized)
6.3 Conduct
Passengers should behave respectfully at all times. Charters may be terminated early without reimbursement if passenger behavior is deemed hazardous or disrupts the excursion for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the charter fees paid. We disclaim responsibility for:
- Injuries caused by passenger misconduct
- Theft or damage to personal belongings
- Indirect or punitive damages
- Delays due to weather or events outside our control
7.2 Insurance Coverage
Our comprehensive marine insurance policy covers both our vessels and operations. It is your responsibility to ensure your own personal and travel insurance coverage.
7.3 Assumption of Risk
Engaging in our charter services implies acknowledgment of inherent maritime risks, accepting personal responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
Modifications to trips, itineraries, or schedules may occur due to weather, safety, or operational needs. We will endeavor to offer equivalent alternative experiences.
9. Force Majeure
Any hindrances, alterations, or cancellations caused by factors beyond our control are not our liability. Such instances may include, but are not limited to:
- Extreme weather events
- Natural catastrophes
- Regulatory enactments
- Port shutdowns
- Mechanical faults
10. Privacy and Data Protection
Your personal data management complies with our Privacy Policy. Using our services signifies your consent to our data collection and usage as detailed in the Privacy Policy.
11. Intellectual Property
Copyright and trademark laws protect our website’s content, encompassing texts, graphics, logos, and images. Unauthorized reproduction, distribution, or derivative creation is prohibited without explicit written authorization.
12. Governing Law
The laws of Spain will govern these Terms, with any related disputes resolved in the courts of Barcelona, Spain.
13. Changes to Terms
